Vacation Rental Agreement

 

North Beach Outlook is pleased to offer you rental accommodations for your visit to Orcas Island.  We hope you enjoy your stay.  To insure an enjoyable visit for you, our future guests and our neighbors, we have a few Terms, Conditions and Rules.  We hope by providing this information to you in advance of your stay, we will all have the same understanding of the expectations.

This Vacation Rental Agreement (Agreement) is entered into on ________________, 20____, by and between North Beach Outlook, LLC (Owner) and Vacation Renter _______________________________ (Tenant).

  1. PAYMENT:  All payments for Rent, Damage Deposit, Cleaning Fee and Taxes, is due and paid in full at the time of the booking. 

  2. CANCELLATION POLICY:  Cancellations must be submitted in writing to the Owner.  If the Tenant cancels at least (30) days prior to the scheduled date of check-in, Tenant will be refunded 100%, at least (14) days prior to the scheduled check-in date, Tenant will be refunded 50%. Otherwise, Tenant forfeits the Rental Fees, less the Security Deposit and Cleaning Fee.  There will be no refunds to Tenant due to weather, late arrival, early departure or any other reason outside of the control of the Owner.

  3. DAMAGE DEPOSIT:  Tenant shall pay a refundable Security and Damage Deposit at the time of booking.  Tenant shall immediately report all damage by phone, text or email to the Owner.  The Security and Damage Deposit will be fully refundable within 14 days of departure if the property requires no excessive cleaning, there is no physical damage to the property, real and personal property are in the same locations and condition as when occupancy commenced, and all the terms of this agreement are met.  Tenant is liable for all replacements and repairs needed to attain the same condition as when occupancy commenced.  Tenant acknowledges that unless the Owner is notified on the Date of Check-In of any damage or cleaning concerns, then thereafter, all such damages or concerns to the Property will be the Tenant’s responsibility.

  4. CHECK-IN/CHECK-OUT:  Check-in is any time after 4pm.  Check-out is at 11am.   A door code with be provided the week prior to the scheduled date of check-in if the Rental Agreement has been signed and received.  Due to the limited services on Orcas Island, early check-in and late check-out times are not available.

  5. TENANT REQUIREMENTS: Tenant must be at least 25 years of age.  No parties allowed. No unsupervised minors.  If the Tenant is found deviating these rules, it will constitute a material breach of the Agreement and will be cause for the immediate eviction of the Tenant.  No refund will be given.  Children must be 5 years old or older.  The house is not designed or equipped for young children.

  6. MAXIMUM OCCUPANCY:  Maximum occupancy is for (6) persons.  Any excess occupancy will constitute a material breach of the Agreement and will be cause for the immediate eviction of the Tenant.  No refund will be given.  No campers, RV’s or tent camping is allowed on the Property.

  7. UNFORSEEN CURCUMSTANCES:  It is expressly agreed and understood that the Owner shall not be liable for circumstances beyond their control including malfunction or breakdown of appliances, including kitchen appliances, washer and dryer, television sets, Wi-Fi Services or other home equipment, or due to unfavorable weather, acts of nature, disruption of utility services or any other situation occurring beyond the control of the Owner.  Owner will attempt to maintain and make necessary repairs to the Property and appliances as expeditiously as possible after being notified by the Tenant of any needed repairs.  Every good faith effort will be made to ensure that the Property is well maintained.  There will be no refund or rebates of any of the Rental Fee in such circumstances.

  8. TELEPHONE:  There is no land telephone line.  You will have to provide your own cell phone service to make calls.  Cell phone service can be spotty on Orcas Island depending on your carrier.

  9. PETS:  There are to be no pets allowed on or inside the Premises.  This includes visits from other people that the Tenant may know or interact with.

  10. SMOKING:  There is no smoking on or inside the Premises.  The Property is equipped with a propane tank and smoking can be dangerous.

  11. SEASONAL AMENITIES:  Certain amenities of the Property may be seasonal in nature, such as, but not limited to, the wood stove and gas grill.  The wood stove will only be available during winter months and the gas grill only available during the high season (approximately Memorial Day through Labor Day). Tenant understands that there are special risks involved using special features, such as the gas grill, wood burning stove, as well as other areas of the Property. Tenant is solely responsible for any accidents that may occur and releases and indemnifies Owner from and against all liability during the term of this Agreement.

  12. PARKING:  Parking is limited to (3) passenger vehicles and vehicles must use the parking spaces located on the Property.  At no time will Tenants park on the street or use the parking spaces of adjacent properties. 

  13. NOISE:  San Juan County has a noise ordinance that limits the level of noise between the hours of 10:00pm and 7:00am.  Please respect our neighbors and our community during these quiet hours.

  14. STAIRS:  This house has three stories, which means there are two flights of stairs.  This Property may not be suitable for very young children or those that are challenged with going up and down stairs regularly.  The kitchen, dining room, living room and access to the deck are on the second floor with bedrooms and bathrooms on the first and third floors.

  15. CLEANING:  There is no laundry service or housekeeping provided during your stay.  You are welcome to use the washer/dryer, vacuum and cleaning supplies. 

 

By signing this Agreement, I acknowledge that I have read this Agreement and agree to comply with the terms and rules contained herein.  I understand that I am responsible for compliance with the terms and rules by all parties who will use the Property during the term of this Agreement.  By signing this Agreement, I certify that I am 25 years or older and have shown proof of age.

Your signature on this Agreement and full payment is evidence of your acceptance of this Agreement and your intent to use the Property for a vacation rental as set forth herein.

After reading and understanding this agreement, please sign and date it, retain a copy for your records and email or mail a fully executed copy to the Owner.  The Owner must receive an executed Agreement prior to the date of Check-In or the Owner supplying the door code.
